There are many papers in which approximate solutions of the Navier-Stokes problem are discussed by finite element methods. Their error estimates are optimal, but the degree of piecewise polynomials for the pressure p or the degree of piecewise polynomials for the velocity u are not the lowest. In this paper a new element is given. Its degrees for p and for u are the lowest and the error estimates are optimal.
