A nice example of a 35-set of type (2,5) in the Desarguesian plane of order nine is constructed. As the author claims, it is the first example of a set of type \((m,q+m)\) with \((m+q)(q^ 2-q+1)\) points in an odd square order plane; in the above mentioned example one has \(m=2\) and \(q=3\).
