Cooperative games with lexicographic, i.e. discontinuous preferences in which agents implement tie breaking procedures are investigated. The main results concern a condition for the non-emptiness of the core in such games. In the case of transferable utility the balancedness is necessary and sufficient for the existence of a non-empty core. In the non- transferable utility case even balanced games with discontinuous utility may have an empty core and the balancedness has to be completed by other properties to be sufficient for the existence of a non-empty core.
