The paper contains two optimal control problems. First one is an optimal control problem for systems governed by a parabolic hemivariational inequality. The cost functional is of Bolza type and the control constraints are time dependent. NEWLINENEWLINENEWLINEThe second one is an optimal shape design problem for systems governed by an elliptic hemivariational inequality. The role of controls is played by a class of admissible domains in \(\mathbb{R}^N\), satisfying the cone property. The result extends the one by \textit{D.
