The author presents an analysis of a recently introduced triangular nonconforming finite element of the third order accuracy in the energy norm. It is shown that this finite element is appropriate for approximating the velocity of incompressible flow problems and satisfies inf-sup condition for piecewise quadratic pressures. No numerical experiments are performed for illustration.
