The author discusses a new form of the patch test and shows that the second counter-example of \textit{F. Stummel} [Int. J. Numer. Methods. Eng. 15, 177-188 (1980; Zbl 0445.65085)] passes it but fails to converge to the true solution with derivative boundary conditions and he explains why Stummel's first example fails the test.
